Terms (ADSp 2017)

We operate exclusively on the basis of the General German Freight Forwarders’ Terms and Conditions 2017 (ADSp 2017). The ADSp 2017 deviate from statutory liability provisions in clause 23 regarding the maximum liability amount for loss of or damage to goods (§ 431 HGB), by limiting liability for multimodal transports including carriage by sea and for cases where the place of damage is unknown to 2 SDR/kg and otherwise restricting the standard liability of 8.33 SDR/kg additionally to EUR 1.25 million per loss/damage event and EUR 2.5 million per occurrence, but at least to 2 SDR/kg.

Limitation of liability (ADSp 2017)

We operate exclusively on the basis of the ADSp 2017 in their currently valid version. The ADSp 2017 contain the above-mentioned differing liability provisions pursuant to clause 23.

Insurance cover

ATS Spedition GmbH maintains ongoing logistics liability insurance. The insurance cover includes statutory and contractual liability arising from freight, forwarding and warehousing contracts pursuant to the German Commercial Code (HGB), the General German Freight Forwarders’ Terms and Conditions (ADSp 2017) and the applicable national and international conventions (e.g. CMR).

The maximum sums insured per claim are: for damage to goods up to EUR 3,000,000, for consequential damage to goods up to EUR 500,000, for pure financial loss up to EUR 500,000.

The maximum insurance benefit per loss occurrence is EUR 6,000,000. The annual maximum insurance benefit is EUR 10,000,000.

Insurance cover for additional transport costs or misrouting is provided up to EUR 50,000 per loss occurrence. Salvage, destruction or disposal costs are insured up to EUR 100,000 per loss occurrence.

Insurance cover applies worldwide for insured transport contracts. For warehousing contracts, insurance cover applies within the European Economic Area (EEA) and Switzerland.

Only the respective insurance terms and statutory liability provisions are decisive.
